Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Insight Yak website and the Insight Yak marketing analytics platform (together, the "Service"), operated by Insight Yak ("Insight Yak," "we," "us," or "our"). By accessing the website or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What Insight Yak provides

Insight Yak is a marketing analytics platform for small and mid-sized businesses. With a customer's authorization, the Service connects to that customer's marketing and analytics accounts — such as Google Analytics, Google Ads, Meta Ads, and Google Search Console — and consolidates the data into a single dashboard with plain-language reporting and recommendations. Insight Yak is a reporting and analytics tool; it reads and reports on a customer's advertising and analytics data and does not create, edit, or manage advertising campaigns on the customer's behalf.

2. Early access program

The Service is offered through a limited early access program while we expand its features and onboarding. Features, availability, and pricing may change as the Service develops, and certain capabilities may be added or removed. We will give customers reasonable notice of material changes that affect a paid subscription.

3. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for the accuracy of the information you provide, for maintaining the security of your account credentials, and for all activity that occurs under your account. Notify us promptly of any unauthorized use.

4. Connected accounts and customer data

To use the Service, a customer authorizes Insight Yak through secure, industry-standard OAuth connections to access specific marketing and analytics accounts. By connecting an account, you represent that you are authorized to grant that access. You may revoke any connection at any time, which stops further data collection from that source. Our collection and handling of personal information is described in our Privacy Policy, which is incorporated into these Terms.

5. Google API Services

Insight Yak's use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements. Data obtained through Google APIs is used solely to provide and improve the analytics and reporting features the customer has requested, is never used for advertising, and is never sold.

6. Acceptable use

You agree not to: (a) use the Service in violation of any applicable law or the terms of any connected third-party platform; (b) attempt to access data belonging to another customer; (c) reverse engineer, probe, or disrupt the Service or its infrastructure; (d) resell or provide the Service to third parties except as expressly permitted; or (e) use the Service to send unsolicited communications or to infringe the rights of others.

7. Fees

Paid plans, where offered, are billed in advance on the schedule presented at sign-up. Fees are exclusive of taxes unless stated otherwise. We may change pricing prospectively with reasonable notice. Any early access or promotional pricing applies only for the period stated.

8. Intellectual property

The Service, including its software, design, and content, is owned by Insight Yak and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription. You retain all rights to your own data; you grant us the limited rights necessary to process it in order to provide the Service.

9. Disclaimers

The Service is provided "as is" and "as available." Insight Yak's reports and recommendations are informational and do not constitute professional, financial, or legal advice; you are responsible for decisions you make based on them. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, and we do not warrant that the Service will be uninterrupted or error-free.

10. Limitation of liability

To the maximum extent permitted by law, Insight Yak will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, or data. Our total liability for any claim arising out of or relating to the Service will not exceed the amount you paid to us for the Service in the three months preceding the event giving rise to the claim.

11. Indemnification

You agree to indemnify and hold Insight Yak harmless from claims arising out of your use of the Service, your data, or your violation of these Terms or of any third-party platform's terms.

12. Term and termination

These Terms apply while you use the Service. You may stop using the Service and disconnect your accounts at any time. We may suspend or terminate access if you breach these Terms or if required to protect the Service or comply with law. On termination, your data and stored credentials are deleted upon request or per our retention schedule described in the Privacy Policy.

13. Changes to these Terms

We may update these Terms as the Service evolves. We will post the revised version here and update the date above; material changes affecting paid customers will be communicated directly. Continued use after changes take effect constitutes acceptance.

14. Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. The exclusive venue for any dispute is the state or federal courts located in Texas.
